***Monday, November 28, 2011, Commissioners did
not meet due to lack of a quorum.
***Tuesday, November 29, 2011, Commissioners met
in regular session with Chairman Ron Smith,
Commissioner Walt Kirby, and Deputy Clerk
Michelle Rohrwasser. Commissioner Dan Dinning
was out of the office attending the Idaho
Roadless Commission meeting in Boise.
9:00 a.m., Commissioners stated for the record
that no Board of Equalization Subroll Appeal
Forms had been received by yesterday’s deadline.
Commissioner Kirby moved to open and close the
time Commissioners sit as Board of Equalization
as no appeal forms for the subroll had been
received by the deadline. Chairman Smith yielded
the chair to second. Motion passed unanimously.
Commissioners tended to administrative duties.
Clerk Glenda Poston and Treasurer Jenny Fessler
joined the meeting.
10:00 a.m., Commissioner Kirby moved to go into
closed session under Idaho Code 67-2345(1)f. To
communicate with legal counsel for the public
agency to discuss the legal ramifications of and
legal options for pending litigation, or
controversies not yet being litigated but
imminently likely to be litigated. Chairman
Smith yielded the chair to second. Commissioners
voted as follows: Chairman Smith “yes” and
Commissioner Kirby “yes”. Motion passed
unanimously. 10:40 a.m., Commissioner Kirby
moved to go out of executive session. Chairman
Smith yielded the chair to second. Motion passed
unanimously.
There being no further business, the meeting
adjourned at 10:40 a.m.
