Commissioners call emergency executive
session

In accordance with Idaho Code 67-2343, the Board
of Boundary County Commissioners will meet to
hold an emergency meeting on Wednesday,
September 25, 2013 at 9:30 a.m.
The meeting will take place in the
Commissioners’ Chambers in the Courthouse for
the purpose of going into executive session
under Idaho Code 67-2345, subsection 1(a) to
consider hiring a public officer, employee,
staff member or individual agent, and (f) to
communicate with legal counsel for the public
agency to discuss the legal ramifications of and
legal options for pending litigation, or
controversies not yet being litigated but
imminently likely to be litigated regarding
Boundary Volunteer Ambulance.
There is no information available to define what
constitutes an emergency, which allows short
notice to the public, or what is to be
discussed in executive session except in a broad
sense; Idaho Code 67-2345 is purposely vague
so as to allow a governing body to consider and
discuss sensitive and narrowly defined issues
outside the public eye.
In any case, neither an emergency nor executive
session is typically called lightly.
There can be no official action taken during
executive session; a motion may be agreed upon,
but no vote can be made until the governing body
reconvenes in public. Under an emergency
declaration, however, that public meeting may be
called immediately after the executive session,
if deemed necessary. |
